I. General Terms and Conditions

§ 1 Basic Provisions

  1. The following terms and conditions apply to contracts that you conclude with us as the provider ( Felix Gampe ) via the website https://umeblossoms.de Close. Unless otherwise agreed, the inclusion of any terms and conditions you may use is hereby rejected.

  2. For the purposes of these provisions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. A business is any natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its independent professional or commercial activity.

§ 2 Formation of the contract

  1. The subject of the contract is the sale of goods.

  2. By placing the respective product on our website, we are submitting a binding offer to you to conclude a contract via the online shopping cart system under the conditions specified in the item description.

  3. The contract is concluded via the online shopping cart system as follows:

    • The goods intended for purchase are placed in the "shopping cart".

    • You can access the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time.

    • After clicking the "Checkout" or "Proceed to Order" button and entering your personal data as well as the payment and shipping conditions, the order details will be displayed to you as an order summary.

  4. If you choose an instant payment system (e.g., PayPal, Amazon Pay, Sofort, giropay), you will either be taken to the order overview page in our online shop or redirected to the provider's website. There you will enter the required information. The order details will then be displayed as an order summary.

  5. Before submitting your order, you have the opportunity to review, change, or cancel the order in the order summary.

  6. By submitting the order via the corresponding button ("order with obligation to pay", "buy" / "buy now", "order with obligation to pay", "pay" / "pay now" or similar designation), you legally declare your acceptance of the offer, thereby concluding the contract.

  7. Order processing and the transmission of all information required in connection with the conclusion of the contract are carried out partly automatically via email. You must ensure that the email address you have provided is correct.

§ 3 Special agreements regarding offered payment methods

  1. Payment via Klarna:
    In cooperation with Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Sweden; "Klarna"), we offer the following payment options. Payment is made to Klarna in each case:

    The use of payment methods such as invoice, installment purchase and/or direct debit requires a positive credit check. Your data will be transmitted to Klarna for the purpose of processing the credit check.

§ 4 Right of retention, reservation of title

  1. You may only exercise a right of retention insofar as it relates to claims arising from the same contractual relationship.

  2. The goods remain our property until full payment is received.

§ 5 Warranty

  1. The statutory warranty rights apply.

  2. Consumers are requested to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to notify us and the carrier of any complaints as soon as possible.

  3. Deviations from the objective requirements are only considered agreed upon if they were expressly agreed upon before the conclusion of the contract.

§ 6 Choice of Law

  1. German law applies. For consumers, this only applies to the extent that the protection afforded by mandatory provisions of the law of the state of their habitual residence is not withdrawn.

  2. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
